Call Fidelma Barry Solicitor to discuss your individual case
Based in Kildare, Fidelma Barry Solicitor provides a specialist service in relation to the preparation and notarisation of Powers of Attorney.
A Power of Attorney enables an individual (donor) to elect another individual (donee/attorney) to sign legal documents on the donor's behalf. In accordance with Irish law, Fidelma Barry Solicitor offer two variations on the service:
A Power of Attorney can be designated or limited to a specific purpose. This can cover such instances where a donor is absent or for property related transactions.
As soon as the donor becomes mentally incapacitated, all powers in both specific and general circumstances are ceased. As per their assigned role, a donee can perform a wide range of duties on behalf of the donor.
This power must be given in writing but no other formalities are required. A donor must have the legal capacity to give the Power of Attorney, and it stands until it is withdrawn by the donor.
An Enduring Power of Attorney is a document which sets out instructions as to how a person wishes assets to be dealt with and by whom if they become of unsound mind (e.g. if you wish for your property to be sold to pay medical or nursing home expenses, etc.).
The complex nature of creating an Enduring Power of Attorney is due to the strict formalities of the process. All necessary procedures must be followed correctly for the Enduring Power of Attorney to come into effect.
