This power must be given in writing but no other formalities are required. A donor must have the legal capacity to give the Power of Attorney, and it stands until it is withdrawn by the donor.

Enduring Power of Attorney

An Enduring Power of Attorney is a document which sets out instructions as to how a person wishes assets to be dealt with and by whom if they become of unsound mind (e.g. if you wish for your property to be sold to pay medical or nursing home expenses, etc.).

 

The complex nature of creating an Enduring Power of Attorney is due to the strict formalities of the process. All necessary procedures must be followed correctly for the Enduring Power of Attorney to come into effect.
